General Terms of Sale



ARTICLE 1 - ACCEPTATION

When the customer orders in the shop, he acknowledges to know the particular terms of sale mentioned on the page and accepts them unreservedly.
The hereby general terms of sale govern the contractual relations between Meilleur du Chef and the customer. They are applicable in particular to the terms of order, of payment, of delivery and of the control of the possible returns of products ordered by the customer.
They are applicable in France (not including French overseas departments and territories, and foreign countries).


ARTICLE 2 - PRODUCTS

The photographs and the texts describing the products are not part of the contractual field. In case of presence of mistakes, they shall not engage the responsibility of Meilleur du Chef. Besides, the customer always has the possibility to get in touch with Le Meilleur du Chef to get additional information on the products presented by sending us a message.
Most of the products sold by le Meilleur du Chef to his customers are available on stock. The availability of the products indicated on the site is only indicative. In case they are temporarily and exceptionally out of stock, we will tell you the delay of supplying necessary to get the wanted product.


ARTICLE 3 - ORDER

An acknowledgement of receipt confirming the taking into account of your order will be automatically e-mailed to you.
Le Meilleur du Chef reserve the right to cancel any order of a customer with whom there would be a dispute concerning a prior order.
Any information given by the customer when ordering binds him; Le Meilleur du Chef shall not be held for responsible for the consequences of mistakes concerning the wording of the details of the consignee of the products or of the debtor of the order.


ARTICLE 4 - PAYMENT

Generalities:
Items must be paid in full the day of the order. The order validated by the customer will be considered effective when the authorised banking payment centres send their acceptation. In case of refusal from the centres, the order will be automatically cancelled.

Online payment by credit card:
The banking information related to the customer (card numbers or expiring dates) are coded by the SSL system and then treated by our financial partner, the Banque Populaire.
Therefore buying an item with Meilleur du Chef site is completely safe.

Other modes of payment:
Check (France only): we reserve your products 8 days until reception of the check.
By post mail: National and International.
On delivery (France only): the amount of your order will be paid directly to the factor during the delivery (supplement of 5.60 Euros for this payment condition).

ARTICLE 5 - PRICES AND BILLS

The prices indicated in the order confirmation by the company Meilleur du Chef include the prices of products, expressed in Euros and in French francs and current at the time of the consultation as well as the expenses of packaging and transport. For the countries members of the European Union, all the services are sold tax included. For countries outside the European Union, sales are made without tax. The payments are made by credit card and the company Meilleur du Chef is credited in euros. The customer is charged in his country's currency following the exchange rate practised by his banking services. The bill is edited by the company Meilleur du Chef and is joined to the goods.


ARTICLE 6 - DELIVERY

Place and delay:
The delivery of our products is carried by our partner carriers in all countries served. The products are delivered at the address of delivery indicated by the customer on his/her order form. If the customer is absent, a delivery notification from the carrier will be placed in the mailbox and will invite the customer to get in touch with the carrier to arrange a later delivery of the parcel or to pick it up at the nearest post office.

Delivery by the Postal services:
The parcels are delivered between 2 and 5 days for any order made before 2 pm, at the condition that the products are available.
The possible delays shall not grant the customer the right to claim Meilleur du Chef for damages. In all cases, delivery on time can occur only if the buyer is up to date in his obligations towards the seller.
It is agreed to consider as events of "Force Majeure" relieving Meilleur du Chef from its delivery liabilities: wars, riots, fires, strikes, accidents, and the impossibilities to be supplied or any other causes that are not under the control of the seller.
The goods are always conveyed under the responsibility of the customer. The customer is advised to check carefully the parcels when they are delivered. The customer is allowed a delay of 48 hours in order to make particular reserves to the conveyor should a product be missing or damaged.


ARTICLE 7 - OUR WARRANTIES

Secured Payment:
The security of your payment is one of our main concerns. That is why all your transactions on Meilleur du Chef are made using in a secured protocol. All the personal data transmitted by our secured server are encrypted before being sent through internet (see about secured paiement).

Our security system:
The banking information of our customers concerning the card numbers or the expiring dates is coded by the SSL system and then it is treated by our financial partner, the Banque Populaire. The information does not pass through the site Meilleur du Chef. The Banque Populaire, alone, has access to the information.
Le Meilleur du Chef has chosen the SSL (Secure Socket Layer) system used by today's leading e-businesses.

Satisfaction or your money back warranty:
We commit ourselves to follow the chart of quality "satisfaction or your money back" of the Fédération des Entreprises de Vente A Distance, FEVAD (federation of mail-order selling firms).

Non accordance of the delivered good:
In case of non accordance of the delivered good with the order le Meilleur du Chef commit themselves to find a solution or to pay back all the involved expenses (freight charges included). However you are advised to call or to e-mail le Meilleur du chef's hotline in the 72 hours following the reception of the good.

Right of retraction:
In accordance with the article L.121-16 of the consumption code, the customer is allowed a delay of 7 days from the delivery date to return the ordered good for the purpose of exchange or paying back.

How to exercise your warranty right of retraction?
You must respect the retraction delay of 7 days: the delay is counted from the date of the goods reception to the date of shipment indicated on the returned good. You must send back the item, intact, in its original package, and imperatively with the optional accessories, the user manuals and the delivery form.

In case of exercise of the right of retraction, le Meilleur du Chef commit themselves to pay back the total of the involved expenses (not including the freight charges: forwarding and shipment back) and that in a maximum delay of 15 days.

General terms of sale:
The hereby general terms of sale are only applicable to the products sold in the shop of Meilleur du Chef as well as to individuals and professionals ordering in the shop.


ARTICLE 8 - WARRANTY AND RETURN POLICIES

All our products are under the supplier's warranty. The conditions of application and the duration of the warranties are specific to each product. Please feel free to contact us for further information by sending a message.


ARTICLE 9 - RESPONSIBILTY

Damages caused by the products on sale: The Meilleur du Chef shall not be held responsible for the damages of any kind, either material or immaterial or corporeal that could result from misuse or dysfunction of the products on sale.


ARTICLE 10 - APPLICABLE LAW - JURIDICTION

All disputes arising in connection with the hereby contract shall be submitted to the appraisal of the conciliation and arbitration centre of Bayonne. In case the disputes should not be settled, they shall be submitted within the competence of the commercial court of Bayonne.


ARTICLE 11 - RESPECT OF IDENTITY

Treatment of nominative information:
It is essential to fill in the nominative information collected for distance sale so that we can treat the orders and invoices. In accordance with the "Informatique et Libertés" (Data Processing and Liberties) Law, the treatment of nominative information related to Le Meilleur du Chef's customers has been declared by the Commission Nationale de l'Informatique et des Libertés (CNIL): N° 745929

Rights to get access to, to modify, to correct or to delete the customer's information:
The customer has the right (article 34 of the law from January the 6th, 1978) to get access, to modify, to correct or to delete the data that are related to him/herself, and he/she may exercise the right by writing to Meilleur du Chef:
